Probate in the Courts
The Probate Courts are a department within the Oregon State Courts. Should a loved one die with Oregon assets subject to a court supervised administration, those assets will be processed by one of the Probate Courts. This is true whether the loved one executed a Will, or died without a Will.
Family members often do not know how to administer the assets of a loved one after death, but nevertheless try to go it alone. Disputes among family members as to distribution can disrupt or stall a court proceeding. Failure to abide by the statutes governing Oregon probates, or missed deadlines can have serious consequences.
